COLUMBIA — A state trooper who hit a fleeing suspect with his car has been indicted by a federal grand jury on a civil rights violation charge in what may be the first of several cases against highway patrolmen.

Trooper Steve C. Garren, 39, of Greenwood, could face up to a $250,000 fine and 10 years in prison for striking a man with his cruiser and later telling other officers, "I nailed the f--- out of him. ... I was trying to hit him."

The 2007 incident, caught on Garren's dashboard video, was dismissed as "locker-room talk" by a solicitor who declined to charge the trooper. The grand jury saw things differently, and members of the Legislative Black Caucus, who pushed for an investigation of the Highway Patrol, applauded that decision.

"To me, it was attempted murder," said state Rep. Leon Howard, D-Columbia, chairman of the caucus. "These guys are nothing more than criminals with badges."

Garren's case is one of more than a dozen controversial trooper stops publicized by The Post and Courier earlier this year after the newspaper obtained copies of the tapes through the Freedom of Information Act.

In one video, a trooper uses his cruiser to chase a suspect on foot through an apartment complex; in another, a trooper tells a suspect, "You better run, (n-word), I'm fixin' to kill you."

When those tapes became public, Gov. Mark Sanford forced out former Department of Public Safety Director Jim Schweitzer and Highway Patrol Col. Russell Roark.

Maj. Mark Keel, the new Public Safety director, on Tuesday suspended Garren without pay.

"It ought to be sending a message to the Highway Patrol," he said. "This type of behavior will not tolerated."

The incident in question happened June 24, 2007, when a man involved in a high-speed chase near Greenwood parked his car on the side of a residential street and took off running.

As he ran across the road, Garren's cruiser clipped the man, sending him flipping into the air.

Garren was given a three-day suspension for the incident, but is appealing that decision.

Eighth Circuit Solicitor Jerry Peace reviewed the case in August, and told The Post and Courier last month that his decision not to charge Garren with a crime was a "no-brainer." There was, he said, no proof of intent.

"All you have to do is look at the tape and see that the guy ran in front of the patrol car," Peace said.

The indictment contends that Garren deprived Marvin Grant of his constitutional right to be free from the use of unreasonable force by a law enforcement officer.

"Allegations of law enforcement abuse are serious, and must be considered carefully," U.S. Attorney W. Walter Wilkins said. "I am confident the grand jury has done just that."

First Assistant U.S. Attorney Kevin McDonald confirmed that the Justice Department is looking at other trooper incidents and that additional figures are expected to be pursued.

Garren is not in custody.

He is expected to turn himself in for an arraign- ment in Greenville later this month.

"It's unfortunate, but it needed to happen," said Lonnie Randolph, president of the state NAACP.

Keel has got a big job ahead of him. This is going to make many troopers disgruntled. He needs to get rid of most of the captains and majors. He needs to do away with the ACE team and completely revamp training. Heed this you bunch of out-of-control and poorly trained troopers; you CANNOT use deadly force to stop someone for speeding just because they choose to run from you!

These types of actions have been going on the S.C. Highway Patrol for far too long. I don't know how they train these guys in Columbia, or from what pool of applicants they choose to pick from but these troopers come out with the attitude that they make the laws in the state, and that they are untouchable no matter what laws they break or no matter how poorly they treat the public.
A judge I once knew, told me once that he was thought that half of these troopers would pay the state just to have the opportunity to wear a badge and a gun. I think that judge was on to something! I hope they put this trooper under the jail and that they send some of his buddies with him. SHAME ON THE HIGHWAY PATROL and the officers who let these actions go unchecked. Every member of the SCHP should have to make a public apology to the people of the South Carolina.

To all of you - for 1 person's actions - don't condemn all and without the patrol of these same officers, where would OUR safety be? I would hope that you might think about your wife or daughter on the road one late night needing help or are you that selfish??? I know for a fact that not all of these officers are guilty by association and I've watched many save lives and protect others - be mindful of your ugliness and who you condemn because you are slandering and condemning innocent officers for no reason!!

K5-you took the words right out of my mouth. It is patently unfair to color all with the same brush. It's funny, those that are doing this are the very ones that have complained of Police stereotyping certain citizens. What's that called? Hypocrisy? That being said, I don't believe anyone condones illegal behavior by Law Enforcement, but I do have to agree with wpc3iop: if you put yourself in a position to be at odds with a Cop by breaking the law, you are just a responsible for the outcome as the Cop is. The outcry here fails to take into account that all professional cirlces in society have bad apples; it's just human nature. The problem with the Police is that when a couple of theirs screw up...it's public and everyone gets to see it then everyone has a knee jerk reaction for the sake of political correctness and pandering for political clout. Look at each case individually on the merits, then decide. None of us were there and we all have the luxury of posting comments and pontificating and reviewing, but the cop at the time had less than seconds to make life and death decisions. I'm not saying that exonerates anyone, but take that into consideration before we puff out our chests and act all indignant and color many brave, selfless public servants as "jack booted thugs" for the acts of a very few.

Finally! Why does it always have to be a civil rights issue that gets the results that a trial should have done? The make up of the jury is black and white would seem to assure that an impartiality exists. But still they get away with it! It is plain and simple that the trooper hit him on purpose and even bragged about it! To say that it was just 'locker room' talk should send chills up and down the spines of every single freedom loving american! It reminds me of the OJ trial! He was guilty! Black jury aquits him!? I don't know the make up of the jury here, only the evidence, and in both cases each were GUILTY! Both went free, later to be found guilty of civil rights.Is there a lesson here? I don't even know any more. I do know one thing. It is going, and is now, getting worse. We are a nation at war with ourselves. This war we will,and are, looseing.I pray if you have not accepted Christ, to do so quickly, and begin praying without ceasing for His will to be done. Some of us will not make it to the place He has prepared for us to spend eternity. The place of everlasting peace. The parable of the sower tells us only one in four of the 6 Billion people. One out of four will be going to spend eternity in hell! THAT should send chills over every person that hears it. Don't be left behind. Love one another today. For Christ sake!

While I do agree the suspect should NOT have run from the police, I don't agree with the cop hitting the suspect, nor his comments. I am not sure if you all watch "World's Wildest Police Videos" but there was a case (I forgot where unfortunately) where a cop was pursuing a suspect and the suspect fishtailed and the suspect tried to escape. The cop drives directly into the door and pins the suspect in. The SUSPECT got paid!! I am glad Garren is being held accountable for his actions and like someone posted earlier, Keel has a LOT of work to do. Hope he can weed out the bad troopers.

This is a solution to all of you law enforcement. Do not stop these people and stay safe in your vehicle. To hell with the rest of the population if this is how they are going to treat you. I bet after all of these criminals take over they will wish you had run over a few more. Thanks to all police officers and tell the public to kiss your rear ends. I am truly sorry you have to serve and be crucified for doing what most of these cowards would not do.

I know several law enforcement officers and MOST of them are honest, hard working people who are doing the job that they were hired to do, trying to earn a living just like the rest of us. It's unfortunate that people will look at the actions of a few and judge them all.

I'm glad to see that there are people in the legal arena who have common sense and will call a spade a spade. These sorts of actions have no place in our state's law enforcement community. All of those hwy patrol officers who have been shown to violate citizen's rights should be fired and jailed. Solicitor Peace needs to face disiplinary action or removal as well. That would be a no brainer!!!

This troopers action was not justified no matter what the circumstance. Hopefully, some of you will recall a couple years ago, here in the low country when we had a similar incident happen. When a trooper got mad that a little old 70 year old granny didn't stop for him quick enough for him, so when she did pull over he yelled and cussed her out and then proceeded to try to pull her out onto the road while she still had her seat belt on. At least that guy was fired soon after.

jerrytj....was you still in the womb when the oj trial went on, cause it was not an all black jury on the case. Maybe the black public jury seen him as being innocent. But I think it was more of can a black man bet the white system. Sorry, but thats how the blacks felt then. A lot of us though he was guilty, but wonted to see what money could do.

It is a shame when the LAW resorts to criminal activity like this...you should be able to enforce the written law without acting as a juvenile. This is not 1920...you will get caught for that type of behavior and you should go to jail. If I don't do my job correctly I will loose it. I think the LEGISLATIVE WHITE CAUCUS should get involved to help defend this officer...oh wait...there IS no Legislative White Caucus, because that would be racist, right???

When are the assbackwards people in our country going to realize that race has nothing to do with anything - a criminal is a criminal whether they be black, white, asian or any other heritage. The black community has feverishly continued to willingly and passionately segregate themselves from the nation as a whole, by their own choice, ever since segregation was abolished 40 years ago.

The officer was punished for this offense and we need to stop going after the authorities who RISK THEIR LIVES ON A DAILY BASIS to ATTEMPT to bring order to our communities and start punishing the criminals who do everything they can make our society unlivable.

My views on this are a little differnet than that of the Grand jury. The Officer should NOT be charged with violating the person's civil rights because he had commited a crime and was fleeing the law. The Officer needs to go to counseling for his statements in the car but theses guys are o n the front lines everyday with these criminals. The Trooper that was shot in Orangeburg county was put in harms ways for stopping someone for a traffice violation. Where the Troopers civil rights in these situations?
We need to make our troopers more prepared and trained for the situations they are likely to be exopsed to but not prosecute them for violating civil rights of criminals.
We need to take care of them not look to prosecute them..

Law Enforcement personnel do not pull you over because they want to have tea and chat. You've broken the law and you're going to get a ticket or get taken to jail (depending on the severity of the offense). Shut up, take the ticket, and get a lawyer. Arguing or pleading with an officer, a deputy, or a trooper is not going to change the reason you were stopped. They're enforcing the laws of the state (thus, "law enforcement")and if you want to plead your case, do it in front of a judge. If a deputy, trooper, or officer tells you to stop and you take off running, chances are you're wanted for something a lot more serious than the offense for which you were detained.

I most assuredly agree that some people with a badge think that his/her shield gives them the right to do whatever they want. I was rear-ended at a stoplight in Florence, SC, last year and I experienced a rude female trooper. When she arrived on-scene, she got out of her cruiser with an attitude and before it was all over, I wanted to slap the crap out of her. She acted like it was such an inconvenience for her to be there. She was treating me like I was at fault for being hit by the yellow-toothed, chain-smoking "Daisy Mae" who hit ME! Male troopers are bad enough, but give one of those power-hungry females a badge, a gun, and a little hat, and God help us all.

A word to the wise......hope you never have the misfortune of having to deal with a State trooper in Florence, SC.

I watched the "video"...I laughed my ass off. That guy went flying!

Com'on people...we all know that everytime a white officer takes "any" law enforcement action against a "brotha", there is a sh*t storm!

The term "brotha" was taken from a shirt worn by blacks that state..."when ya see da cops comin, warna brotha" Someone should've "warna him".

THANK-YOU!!!!!!!! I was wondering how long it would be before people woke up....

As for justification for overall public safety.... May be... but it's gotta be AT LEAST 5 of us innocents that get abused just the same for every 1 criminal they may actually catch. I REFUSE to give "default" respect to those who disrespect me, badge or not. And officers who live off that power/adrenaline high, like to take other measures when they find that they don't strike initial fear within you... just like any other criminal without a badge. And then they have the nerve to wonder why people try and kill police... I say it's about time they did something (indictments, that is)!

And I agree with JohnQ: "Throw these cops in jail with those they have abused for all these years, justice will be served..." Stop slapping em on the wrists, and treat em like any other criminal!

lay off the doughnuts and get out the car for a foot chase and run after them to catch the suspect. They really messed up when they put in drive-thru at krispey kreme and dunkin doughnuts, we have confused police now.REGUARDLESS IF THEY ARE BLACK OR WHITE IT HAS NOTHING TO DO WITH IT WHAT PAC-MAN DID WAS WRONG . I have no problem with the officer did. If the person being chased had just committed a heinous crime, and he got away because the officer had to take time to pull his vehicle off the road, exit and start chase on foot, calling in for backup, not knowing if the suspect had a weapon, and risking his own life... I just wonder how many comments would change on this article.

If I ranned from a cop I deserve to be rammed over by his car? Nope not at all.
I do agree people should not run away from the police officers but there is no reason for a cop to get all Captain Caveman and knock someone around because they did not like the suspect running. Half of you all won't beat your kid but want other folks to get beat up for not obeying instructions. We have a lot of work to do. If we take the few little things out of this article that got some of yalls panties all bunched up I think our post would be different.

SO what if their is a Black Caucus. Holyplay if you want a white caucus go ahead and plan one. There are also Italian civil right groups, women groups, animal groups, Indian civil group leaders, and a host of many more. Don't let just this one upset you you can have a reason to dislike other groups. If the directors of Operation Freedom (just a name I threw out there) got involved would your post still be the same? This has nothing to do with black or white, its about SOME police officers abusing their power. These officers are not the judge, jury, or the executioner. Once they start taking the law into their own hands, they are then vigilantes. No matter how much a vigilantes think they are justified for their actions, they are still called into court and charged with a crime.

Oops, hello everyone. I was just reading these posts and thought that many of them were hilarious and others were just plain ignorant and sad. People like 145 and the other personality he has are what is wrong in race relations today. They all need to be shipped off to a remote island (that includes racists and bigots of all ethnicities and backgrounds) and left their to live among themselves for the rest of eternity. Everyone keeps saying the officer used unnecessary force with a deadly weapon, but, what about the fact that this whole incident included a high speed chase? Did the criminal not use a deadly weapon for that? Would you still be saying this P.O.S. was "abused" if he had hit one of your family members prior to getting out of his vehicle?

Did the officer use excessive force? Should he have not "showed out" to his buds? Doesn't matter because we the tax payers will be handing over our hard earned money to a non-deserving criminal with a leach of a lawyer looking at a great get rich quick scheme.

PT- If he used his vehicle as a weapon then yes he did use deadly force, but he was running. He look just like a character on the Road Rage Simpson's video game being hit like that.

We all need to be careful now adays because folks like to sue. If people are suing McDonalds because their butts are too big, you know we are in a world of trouble. I know eating a whooper, fries, and drinking a diet coke is not going to help me, but I got to blame someone. You are right though the taxpayer lost this one...

I am not defending a white trooper or trying to justify abuse of a black man - I don't care what shade of green you are either, I will still say the same thing. A person used a deadly weapon and endangered law abiding citizens on the road. The trooper did not have the common sense of a mosquito. Bad combination either way. And we, the tax payers, are going to pay for this - PERIOD. The next time you hear about Marvin Grant it will contain a quote from his attorney regarding the suit he filed against the state.

Hell, based on some of the posts, he could have pulled out his gun and shot the kid and that would have been fine with some of you. The kid was stupid for running but you don't try to run someone down with your car because you are mad that they ran from you.

What I'm happy about is the cameras in the trooper's cars now. I can't imagine how many times something like this may have happened over the years and it got covered up. I believe in karma. This was not the first incident for this trooper. Karma caught up to him.

If you feel this way - then you've done wrong yourself!! If you are getting pulled over by the law - you are doing something wrong to start with and if you get out and run, it's because you have something to hide (usually - it's a suspended/or no license to be driving in the 1st place, drugs/alcohol in the car, no insurance, expired tags, etc....)! That is what all of you fail to understand here! Have any of you put YOUR lives on the line and ridden in a car with an officer? Has that Representative that so unjustly made that remark? Of course not! Too bad!! Maybe he ought to - maybe with his luck the officer that he is riding with will pull over a "bad apple" car that starts shooting back at the patrol car and puts HIS life in jeopardy and it might change the representative's perspective!! All of you are might judgemental to have never ridden in that hot seat yourselves!!! I asked to ride one night - I won't ever judge again!
